Personal Data Protection Conditions

I. Basic Provisions

The controller of personal data according to Article 4, Point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "GDPR") is BASTL s.r.o., with its registered office at Kounicova 276/23, 602 00 Brno - Veveří, Company ID: 28299663, and VAT ID: CZ28299663, registered in the Commercial Register under file number C 59598/KSBR (hereinafter referred to as the "Controller"). Personal data refers to any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, particularly by reference to an identifier such as a name, identification number, location data, online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person. The Controller has not appointed a Data Protection Officer.

II. Sources and Categories of Processed Personal Data

The Controller processes personal data that you have provided or personal data that the Controller has obtained based on the fulfillment of your order. The Controller processes your identification and contact data, as well as data necessary for contract performance.

III. Legal Basis and Purpose of Personal Data Processing

The legal basis for processing personal data is:

  • The performance of a contract between you and the Controller according to Article 6, Paragraph 1(b) of the GDPR,
  • The legitimate interest of the Controller in providing direct marketing (especially for sending commercial communications and newsletters) according to Article 6, Paragraph 1(f) of the GDPR,
  • Your consent to processing for the purposes of direct marketing (especially for sending commercial communications and newsletters) according to Article 6, Paragraph 1(a) of the GDPR in connection with Section 7, Paragraph 2 of Act No. 480/2004 Coll., on certain information society services, in cases where no goods or services have been ordered.

The purposes of processing personal data are:

Processing your order and fulfilling rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data necessary for successful processing of the order (such as name, address, and contact details) are required. Providing personal data is a necessary requirement for entering into and fulfilling the contract, without which it is not possible to conclude or fulfill the contract by the Controller,

Sending commercial communications and conducting other marketing activities.

The Controller engages in automated individual decision-making within the meaning of Article 22 of the GDPR. You have given your explicit consent to such processing.

IV. Data Retention Period

The Controller retains personal data:

For the period necessary to exercise rights and fulfill obligations arising from the contractual relationship between you and the Controller and to enforce claims arising from these contractual relationships (for 10 years after the termination of the contractual relationship),

Until the consent for processing personal data for marketing purposes is revoked, but no longer than for 3 years, if personal data are processed based on consent.

After the expiration of the personal data retention period, the Controller will delete the personal data.

V. Recipients of Personal Data (Controller's Subcontractors)

Recipients of personal data are individuals or entities:

Involved in the delivery of goods/services/processing of payments based on the contract,

Providing services for the operation of the e-shop and other services related to the operation of the e-shop,

Providing marketing services,

For the purpose of accounting tax documents in accordance with the contract and generally binding legal regulations, to the extent of:

Name and surname, title,

Postal address,

Billing address,

Email address,

Telephone contact,

Bank account information,

Details of the Controller’s performance.

The Controller does not intend to transfer personal data to a third country (a country outside the EU) or to an international organization.

VI. Your Rights

Under the conditions set forth in the GDPR, you have:

The right to access your personal data under Article 15 of the GDPR,

The right to correct personal data under Article 16 of the GDPR or restrict processing under Article 18 of the GDPR,

The right to erase personal data under Article 17 of the GDPR,

The right to object to processing under Article 21 of the GDPR, and

The right to data portability under Article 20 of the GDPR.

The right to withdraw consent to processing in writing or electronically to the address or email of the Controller as specified in Article III of these terms.

You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.

VII. Personal Data Security Conditions

The Controller declares that it has taken all appropriate technical and organizational measures to secure personal data. The Controller has taken technical measures to secure data storage and personal data in physical form (e.g., password protection, antivirus software, and firewall) and physical security measures (e.g., locked rooms). The Controller declares that personal data is accessible only to authorized persons.

VIII. Final Provisions

By submitting an order from the online order form, you confirm that you are aware of the personal data protection conditions and that you accept them in full. You agree to these terms by checking the consent box via the online form. The new version of the personal data protection terms will be published on the Controller's website and will also be sent to your email address, which you provided to the Controller.
